    Information on the controllers and on the rights of the person whose personal data is processed:

    Pursuant to art. 13 sec. 1 and 2 of the Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (the GDPR) we inform that:

    1. The administrator of Users’ personal data is Miejskie Przedsiębiorstwo Wodociągów i Kanalizacji S.A. based in Wrocław, with its seat at ul. Na Grobli 14/16, 50-421 Wrocław, entered into the Register of Entrepreneurs of the National Court Register by the District Court for Wrocław-Fabryczna, 6th Commercial Division of the National Court Register, under the KRS number: 0000391028, with the share capital of PLN 480 159 150.00 (paid in full), NIP: 8960000256, REGON Number: 930155369.
    2. Your personal data will be processed by the Controller on the basis of your consent only for
      • related to the procurement proceedings - review of an offer,
      • at the moment of settling the procedure in order to conclude an agreement and perform the subject of the procurement,
      • the possible establishment, assertion or defense of claims, as well as to provide proof, in the exercise of justice by the courts,
      • for archival purposes, in accordance with the obligation incumbent on the Controller.
    3.     4. Your data will be processed by Logintrade S.A. And LT Serwis sp.z o.o on the basis of your consent for the sole purpose of ensuring the fulfillment of the tasks of the Procurement Platform.
    5. The Controller will process your personal data:
      • for a period of 4 years from the date of completion of the procurement procedure;
      • if the duration of the concluded agreement exceeds 4 years, for the duration of the agreement; after the execution of the subject of the agreement for the period of the warranty to which the Controller is entitled;
      • until the deadline for any claims under the agreement (up to 10 years from the due date of the claim imposed by a final court judgment);
      • and the expiry of the period ensuring the fulfillment of the archiving obligation incumbent on the Controller (min. 5 years).
      the above periods are cumulative.
    6. You have the right to access the content of your personal data and to rectify, erase or limit their processing and rectification, and the right to object to the processing and to transfer the data.
    7. You have the right to withdraw your consent to the processing of your data at any time. The exercise of the right of withdrawal shall not affect processing carried out on the basis of the consent prior to the withdrawal.

    10. You have the right to lodge a complaint with the supervisory authority if, in your opinion, the processing of your personal data violates the provisions of the GDPR Regulation.
    11. You provide personal data voluntarily, but this is a prerequisite for using the Procurement Platform..
    12. The recipients of your data will be the entities whom the Controller, which is MPWiK S.A.:
      • is obliged to provide data on the basis of the current legal regulations (i.a. Police; Municipal Police; Public Prosecutor's Office, Court);
      • persons or entities to whom the documentation of proceedings will be made available on the basis of art. 8 and art. 96, sec. 3 of the Public Procurement Law Act;
      • these may be contractors or service providers for the benefit of the Controller (processors) incl.:
        • suppliers of IT services,
        • entities providing: delivery services; postal services; legal services; debt collection services; services of: printing, addressing, personalization of documents and attachments to documents, delivery packaging.
    13. Please be advised that Logintrade S.A. and LT Serwis sp. z o.o. do not envisage the processed data to be made available to any recipients of this data.
    14. The administrator does not allow the use of the services listed in these Rules anonymously or under a pseudonym.
    15. Your personal data will not be processed automatically and will not be profiled.
